1. Agreement to Terms

By accessing or using Atletiq ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including club administrators, staff members, coaches, guardians, and players.

2. Description of Service

Atletiq is a software-as-a-service (SaaS) platform designed to help youth sports clubs manage their operations, including but not limited to:

• Player registration and profile management
• Team organization and squad management
• Training session scheduling and attendance tracking
• Match scheduling and result recording
• Guardian and parent communication
• Staff and coach management
• Venue booking and management
• Club administration and reporting

3. Account Registration

3.1 Club Registration

To use Atletiq, a sports club must register for an account. The person registering on behalf of the club represents and warrants that they have the authority to bind the club to these Terms.

3.2 Account Security

You are responsible for safeguarding the password used to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3.3 Age Requirements

Staff and guardian accounts must be held by individuals who are at least 18 years of age. Player accounts for minors are managed under the supervision of registered guardians within the platform.

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including privacy and intellectual property rights
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Collect or harvest any information from the Service without authorization
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service for any purpose that is harmful to minors
• Share login credentials with unauthorized individuals
• Use automated systems to access the Service without our express permission

5. User Content

5.1 Responsibility for Content

You are responsible for all content that you upload, post, or otherwise transmit via the Service ("User Content"). You represent and warrant that you have all necessary rights to your User Content.

5.2 Content Standards

User Content must not contain any material that is defamatory, obscene, threatening, or otherwise objectionable. Content involving minors must be appropriate, relevant to club activities, and uploaded only with proper consent.

5.3 License to User Content

By uploading User Content, you grant Atletiq a non-exclusive, worldwide, royalty-free license to use, store, and display such content solely for the purpose of providing the Service.

6. Subscription and Billing

6.1 Subscription Tiers

Atletiq offers various subscription tiers with different features and pricing. The current pricing and features are available on our pricing page. We reserve the right to modify pricing with 30 days notice.

6.2 Trial Period

New clubs may be eligible for a free trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service, or your access will be limited or terminated.

6.3 Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

6.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. After that, your account will be downgraded and data may be subject to deletion after a retention period.

7. Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

As the Service handles data relating to children, we are committed to the highest standards of data protection. Club administrators are joint data controllers with Atletiq and must ensure they have appropriate lawful bases for processing personal data within the platform.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by Atletiq and is protected by international copyright, trademark, and other intellectual property laws.

8.2 Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your club's internal business purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLETIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or relating to these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Atletiq and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including privacy rights
• Any User Content you upload or transmit through the Service

12. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or using the cancellation features within the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Atletiq is registered, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the modified terms, you must stop using the Service.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Atletiq concerning the Service.
